Pixbyte Development's Privacy Policy

Your privacy is very important to us at Pixbyte Development GmbH ("Pixbyte"). Pixbyte doesn't collect a lot of personally identifiable data about you, what Pixbyte does collect is used only for limited purposes, and Pixbyte will not share it with third parties except as provided below.

This Privacy Policy is incorporated into and is subject to the Terms of Use and any other agreements that govern Pixbyte's web properties. By using the Pixbyte Site (“Site”) and/or providing Pixbyte with information as set forth herein, you expressly consent to be bound by the terms of this Privacy Policy. Please note that Pixbyte may modify this policy without advance notification, so please check back here from time to time. To make your review easier, Pixbyte posts the date this Privacy Policy was last updated at the bottom of this page.

Information Pixbyte Collects
Information You Give Pixbyte: You provide Pixbyte with certain personally identifiable information (such as your name and email address) when you register for an account that enables you to participate in certain services on the Site, including posting or uploading source code and/or binaries, posting messages in our Community message boards, downloading free trial versions of Pixbyte software, or subscribing to newsletters or other mailing lists. You also provide Pixbyte with additional personally identifiable information (such as your address, credit card information and certain tax-related information) when you make purchases from the Site and/or sell content through the Site.

Cookies Information: When you visit the Site, Pixbyte may send one or more cookies - small text files containing a string of characters - to your computer that uniquely identifies your browser. Pixbyte use both session cookies and persistent cookies. A session cookie is temporary and disappears after you close your browser. In contrast, a persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Site to help identify you and maintain your signed-in status. You may remove persistent cookies by following your browser's directions. You can also reset your browser to refuse all cookies or to indicate when a cookie is being sent. If you do so, however, some features and services of the Site may not function properly.

Log File Information: Pixbyte servers automatically record certain information that your web browser sends whenever you visit the Site. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, platform type, click rates, pages viewed and the order in which those pages were viewed, the amount of time spent on particular pages, the date and time of your web request, and one or more cookies that may uniquely identify your browser.

Product Information: Pixbyte software products generally do not collect any personally identifiable information about you during installation. Although once installed they may occasionally access the Internet to check for version updates, retrieve rotating interface images, and confirm image impressions and product installations, no personally identifiable information is stored on our servers during or as a result of any of these interactions. There are a few exceptions to this. For example, the first time you start the Pixbyte Manager application, you will be asked if you would like to send us information about your system configuration. You are free to choose to send Pixbyte this information or not, and a button is provided during the process that allows you to review all of the information before it is sent. This information is used for diagnostic and product planning purposes only, and is stored in a separate database that is not in any way linked to personally identifiable information. In addition, on occasion, Pixbyte may bundle third-party software with our products. As a rule, Pixbyte choose not to include such software that Pixbyte think will collect information inconsistent with this Privacy Policy, but please read and understand the privacy policy distributed with that third party's product before agreeing to install any such bundled software.

Security Information: Pixbyte are committed to protecting copyrighted content by, among other things, tracking which consumer electronics devices have been registered to your account and logging and authorizing requests to download purchased content that are related to registered and networked devices.

Please note that any content you upload or post on the Site is published and made publicly available and is not considered personally identifiable information subject to this Privacy Policy. Further, any personal information that you voluntarily disclose when participating in services available on the Site (including on Pixbyte message boards, in content you upload to the Site, within your public profile page, etc.) becomes publicly available and can be viewed and/or used by others. Further, please be aware that while the username you choose (but not your email address) is displayed to other visitors when you upload content or participate in the Pixbyte Community, other visitors can contact you through messages and comments.

How Pixbyte Uses Information Collected:.
  • By registering for an account, you consent to Pixbyte use of personally identifiable information, without seeking your further consent, for non-marketing or administrative purposes, including but not limited to notifying you of developments relating to your transactions on the Site or to your account, requesting your feedback on Pixbyte  Site via surveys, and/or for customer services or data security-related purposes.
  • If you choose to subscribe to the Pixbyte newsletter when registering for an account and/or making a purchase through the Site, We will use your email address and/or other personally identifiable information to send you periodic mailings about recent developments on the Site and updates on new versions of Pixbyte  software. You may opt-out of receiving future newsletter mailings at any time by changing your profile.
  • Pixbyte will not use your email address and/or other personally identifiable information to send commercial or marketing messages without your consent, unless such messages are part of a specific Pixbyte promotion for which you will have the ability to either opt-in or opt-out.
  • Pixbyte uses your personally identifiable information as well as some non-personally-identifiable information (including anonymous usage patterns, cookies, IP addresses, browser type, click rates, etc.) to enable Pixbyte to continually improve the quality and design of the Site and to develop new features, promotions, and services.
  • Pixbyte uses cookies, log file and single-pixel information to: (a) remember information so that you will not have to re-enter it during your current or next visit to the Site; (b) provide you access to targeted and/or personalized content and information; (c) monitor the effectiveness of our marketing and promotional campaigns; (d) monitor and compile certain Site-related statistics including the total number of visitors, pages viewed, average time spent per page, etc.; and (e) track your participation in promotions and special programs.
When Pixbyte Discloses Information Collected:
  • Pixbyte provides personally identifiable information and non-personally-identifiable information to third party companies solely as necessary to process transactions relating to the purchase and/or sale of content, software or other material via the Site and/or to maintain your accounts. Pixbyte require that these parties agree to use and process such information in compliance with this Privacy Policy, and Pixbyte use reasonable efforts to limit their access to and use of such information. Pixbyte, or these parties on our behalf, will also share some personally identifiable information (such as name, credit card number, tax id number, etc.) with banks, other financial entities that process credit card transactions, and/or applicable governmental and tax authorities.
  • Pixbyte will not share your personally identifiable information (such as your name or email address) with other, third party companies for their own commercial or marketing purposes without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.
  • Pixbyte may, however, share aggregate, non-personally identifiable information (including anonymous usage patterns, cookies, IP addresses, browser type, click rates, etc.) with third party companies that wish to learn more about usage patterns for certain software downloads, services, advertisements, and/or promotions associated with the Site.
  • Pixbyte reserve the right to disclose any personally identifiable information and/or non-personally identifiable information about you without your prior consent if Pixbyte have a good faith belief that such disclosure is reasonably necessary to (1) satisfy any applicable law, regulation, legal process or enforceable government request, including subpoenas from private parties in a civil action; (2) detect, prevent or otherwise address fraud, security or technical issues; (3) enforce the provisions of this Privacy Policy, Pixbyte Terms of Use, and/or any other agreements between you and Pixbyte, including investigation of potential violations thereof; or (4) protect against imminent harm to the rights, property or safety of Pixbyte, its visitors and/or the public.
  • Should Pixbyte ever be acquired by or merged with another entity, Pixbyte reserve the right to transfer or assign all information Pixbyte have collected from our visitors as part of such merger, acquisition, sale, or other change of control. In the event of Pixbyte’s bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, Pixbyte may not be able to control how your personal information is secured, used and/or disclosed.
Your Choices:
  • Pixbyte works hard not to collect any more personally identifiable information than is reasonably necessary, and to give you the choice whether to provide such information to Pixbyte.
  • Should you choose not to provide Pixbyte with certain personally identifiable information, however, Pixbyte may not be able to provide certain services to you and/or some of the Site's features may not function properly.


Children's Privacy And Protection
Pixbyte does not intentionally target or direct its services at children under the age of thirteen (13), and does not knowingly collect or maintain personal information from children under the age of thirteen (13). In addition, Pixbyte does not permit any child under the age of thirteen (13) to participate in the Pixbyte Community, including without limitation any Pixbyte message boards. If Pixbyte learns that a child under 13 is publicly posting or sharing personally identifiable information, such information will be deleted from the Site and that visitor will be blocked from accessing Pixbyte in the future.

International Visitors
The Site is hosted in Germany and is governed by German law, this Privacy Policy, and the Terms of Use. If you access the Site from another country, including without limitation the European Union, with laws or regulations governing the collection, use, and disclosure of personal data that differ from German laws, please be advised that through your continued use of the Site, you are transferring your personal information to Germany, as set out herein, and you consent to that transfer.

How Pixbyte Secures the Information Collected
Pixbyte uses your personal information only for the purposes for which it was collected and only in accordance with this Privacy Policy and any applicable service-specific privacy notice. While Pixbyte take reasonable steps to ensure that all personal information Pixbyte process is accurate, complete, and current, We depend on Pixbyte’s visitors to update or correct their personal information whenever necessary. Further, to protect your privacy and the security of your personally identifiable information, Pixbyte take commercially reasonable steps, including by requiring a unique password, to verify your identity before granting you access, including to make corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times.

Pixbyte is committed to and do take appropriate and commercially reasonably security measures to preserve the integrity and security of your personal information and to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These measures include but are not limited to internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where Pixbyte store personal data. For example, once transmitted to Pixbyte, your address, credit card number, social security number and/or tax identification number will always be stored in an encrypted form.

Pixbyte restrict access to personal information to Pixbyte employees, contractors and agents who need to know that information in order to operate, develop or improve our Site and services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Pixbyte cannot and does not, however, ensure or warrant the security of any information you provide to Pixbyte and by your use of the Site and/or registration for an account, you acknowledge and agree that you do so at your own risk.
